Impound a Forcible Entry-New Law Effective Now

Public Act 096-1131 was signed into law and is effective as July 20, 2010 and is printed below. Please take time to read it and share it with your Civil Clerks.

    AN ACT concerning civil law.

    Be it enacted by the People of the State of Illinois,
represented in the General Assembly:

    Section 5. The Code of Civil Procedure is amended by adding
Section 9-121 as follows:

    (735 ILCS 5/9-121 new)
    Sec. 9-121. Sealing of court file.
    (a) Definition. As used in this Section, "court file" means
the court file created when a forcible entry and detainer
action is filed with the court.
    (b) Discretionary sealing of court file. The court may
order that a court file in a forcible entry and detainer action
be placed under seal if the court finds that the plaintiff's
action is sufficiently without a basis in fact or law, which
may include a lack of jurisdiction, that placing the court file
under seal is clearly in the interests of justice, and that
those interests are not outweighed by the public's interest in
knowing about the record.
    (c) Mandatory sealing of court file. The court file
relating to a forcible entry and detainer action brought
against a tenant who would have lawful possession of the
premises but for the foreclosure on the property shall be
sealed pursuant to Section 15-1701.

    Section 99. Effective date. This Act takes effect upon
becoming law.

signatures of Abraham Lincoln stolen--Montgomery County

Dear Cleks, (DO NOT HIT REPLY TO THIS EMAIL)

Somewhere between 1995-2000, our county had some signatures of Abraham Lincoln stolen. It is my understanding that several other counties had documents or signatures stolen around this same time by the same guy. I'm trying to track down a name of the guy that stole these signatures. If I remember correctly, this person claimed to work for archives or something along those lines. Does this ring a bell with anyone? Thanks for your help!

IACO/IACC Spring Conference 2010 Registration

Also, I need to know if anyone is coming to the conference that has not register yet. The Crowne has changed the billing process and we pay in advance then settle up later, so I really would like to be close to the count.

As of Friday we have 81 clerks registered for the IACO Conference and 4 additional for Tuesdays training only.

Changes to the Treasurer's Office Remittance Form

The Office of the Illinois State Treasurer has revised the Circuit Clerk Remittance Form. The form has been revised to remove the line for recording Domestic Violence Surveillance Fund remittances. Pursuant to Public Act 96-688, the Domestic Violence Surveillance Fund no longer exists. Therefore, our Office will no longer be accepting remittances for deposit into the Fund. The revised form is being sent as an attachment to this email and can also be accessed at the following link to the Illinois State Treasurer’s Office website: http://www.treasurer.il.gov/finances/ffrf/pdf/CircuitClerkRemittanceForm2010-04-08IAForm.pdf

n addition, the Treasurer’s Office would like to remind you that our Office accepts ACH payments. Instructions for ACH payments have also been sent as an attachment to this email.

IACC Spring Training 2010

Hello to all of you. I am looking forward to seeing you at the upcoming May conference at the Crowne Plaza here in Springfield. I wanted to send you a note to let you know that the content of the Tuesday, May 4 training will be on the topic of appeals. Fourth District Presiding Justice Sue E. Myerscough will be our guest presenter along with a welcome that morning from Honorable Juleann Hornyak, Clerk of the Supreme Court.

Following Justice Myerscough's presentation, we will have all five Appellate District Clerks/chief deputies as panelists to discuss the nuts and bolts of preparation of the appeal record and related matters. I encourage those of you who are able to bring your appeals staff to do so. We will break into groups by district for the second half of the morning so that the districts can gather with their own Appellate Clerk. Bring your questions!

I have attached a draft agenda. There may be a few minor changes to this before May 4, but it will be substantially the same as far as content. Looking forward to seeing everyone!

Awash in paper, court clerks go digital

County Accepts Electronically Filed Document

To grasp just how much paperwork the Madison County Circuit Clerk's Office handles every day, take a look at the cramped county courthouse basement in Edwardsville.

There, sealed off from the public, sit dozens and dozens of rolling shelves, each stuffed to the ceiling with thick manila folders and packed papers.

"This is just asbestos cases," said Chief Deputy Clerk Judy Nelson, pointing to four library-sized units brimming with files, during a visit Monday morning. "It's a lot of dead trees."

That massive workload - the 3rd Circuit Court processed 103,387 cases last year - is one reason why the state Supreme Court picked Madison County last year to test an electronic court case filing program.

The system, which started April 6, lets attorneys from both sides of a case digitally input many of the documents they would have had to physically submit at the courthouse. The information is then beamed to deputy clerks, who make sure the data fits with court rules.

Jim Maxey Arrangements Pending

Dear Clerks,

It is with heavy heart and deep sorrow that I share with you the news regarding our long time friend and associate Jim Maxey. Jim was know by County Officials all across this state. He warm smile, his tender heart, and always having a few minutes to chat will be missed by all of us.

Jim Maxey lost his battle with cancer on Tuesday afternoon 02/17/09. He died from pneumonia, a complication of his two year battle with lymphoma.

Arrangements are pending and I will post them as soon as they are available. The Illinois Association of Court Clerks will be contributing to Jim's Memorial choice.

Please keep his family in your prayers.
